City Accepting Bids for Mowing Weed/High Grass Violation Lots Share

ADVER­TISE­MENTS FOR BIDS FOR THE MOW­ING OF WEED VIO­LA­TION LOTS LOCAT­ED IN THE CITY OF MARION

Sealed bids will be received by the City of Mar­i­on Code Enforce­ment Depart­ment, locat­ed at 301 S. Bran­son St. Mar­i­on, IN 46952 until 3:00 p.m. (local time) on Fri­day, April 28, 2023, and then will be pub­licly opened and read aloud at 10:00 a.m. (local time) on Mon­day, May 01, 2023, at the reg­u­lar meet­ing of the City of Marion’s Board of Pub­lic Works and Safe­ty at the above address. Any bids received lat­er than the above time will be returned unopened. Blank bid pack­ets are avail­able in the Code Enforce­ment office on the 3rd floor at the above address

DESCRIP­TION OF WORK: Each par­cel will be mowed, bushed hogged, or weed­ed. All grass and weed clip­pings shall remain on parcels, and no grass or weeds on side­walks or streets.

Any large items or debris will be report­ed or not­ed on the work order.

INSUR­ANCE: Each bid­der must show proof of lia­bil­i­ty insur­ance of a min­i­mum of $100,000.00 and must be sub­mit­ted with your bid.


The fol­low­ing is the notice sent out to prop­er­ty own­ers in violation:

NOTICE TO ABATE ENVI­RON­MEN­TAL PUB­LIC NUI­SANCES (WEED & HIGH GRASS; HIGH­ER THAN 9 INCH­ES) TO ALL PROP­ER­TY OWN­ERS IN THE CITY OF MARION

You are here­by noti­fied that if any envi­ron­men­tal pub­lic nui­sance vio­la­tions as defined in Gen­er­al Ordi­nance 10 – 2005 are not cor­rect­ed by June 01, 2023, and the prop­er­ty is main­tained free of vio­la­tions, the vio­la­tions will be cor­rect­ed by the City of Mar­i­on or it’s agent, and the own­er of the prop­er­ty shall be charged with the cost under the pro­vi­sions gen­er­al Ordi­nance 10 – 2005 Sec­tion F(3) or any of its amend­ments, addi­tions and/​or poli­cies estab­lished by the City of Mar­i­on Code Enforce­ment Depart­ment. Envi­ron­men­tal pub­lic nui­sances are defined, but not lim­it­ed to; any growth of weeds, grass, or oth­er rank veg­e­ta­tion, which is neglect­ed, dis­card­ed or not cut or mowed oth­er­wise removed which has attained a height of nine (9) inch­es or more, or any accu­mu­la­tion of dead weeds, grass, brush or trees. The City of Mar­i­on or its agent may cor­rect the envi­ron­men­tal pub­lic nui­sance vio­la­tions as many times as nec­es­sary to com­ply with this ordi­nance and charge the actu­al cost to the prop­er­ty own­er. The cost shall not be less than One Hun­dred Dol­lars ($100.00) in admin­is­tra­tive fees and not exceed Twen­ty-Five Dol­lars ($25.00) per hour, per work­er, for labor and not exceed Six­ty-Five dol­lars ($65.00) for equip­ment per hour, plus attor­ney fees and court cost. If the own­er fails to pay the amount owed with­in ten (10) days of receiv­ing the state­ment, a lien may be placed upon the ben­e­fit­ted prop­er­ty. This notice is in effect begin­ning June 1, 2023, and end­ing Decem­ber 31, 2023. The name, address, and con­tact infor­ma­tion of the Chief Code Enforce­ment Offi­cer for the City of Mar­i­on and whom ques­tions and com­ments con­cern­ing this mat­ter as set out here­in may be addressed is:
